In the letter dated 19.12.2024 and numbered 13859, sent to our Chamber from the Union of Chambers and Commodity Exchanges of Türkiye,

From the consumer complaints conveyed to our Ministry, it has been understood that in establishments such as restaurants where food and beverage services are offered, the same type of product is offered in different methods and sizes at different prices, because the weight information of the products is not included in the tariff and price lists, consumers cannot make a sound price comparison and are aggrieved due to this incomplete information.

Among the businesses operating in food and beverage services, it is observed that the most preferred products by consumers are döner, iskender kebab and hamburger products, and these products are widely consumed throughout the country due to their fast service and affordability.

Consumer complaints submitted to our Ministry, as well as inspections and audits conducted by our Ministry, have revealed that döner, which traditionally should be sold by weight, is being sold by businesses such as restaurant and buffet chains under different names such as "Döner Sandwich," "Döner Between Bread," "Dürüm Döner," and "Served Döner," at different prices. Iskender and hamburger products are being sold in different portion sizes. However, due to the lack of weight information, price comparisons cannot be made and consumers are being misinformed. Therefore, it has become necessary to take measures to prevent consumer grievances specific to this product.

In this context, considering that döner products, Iskender products and the widely preferred hamburger product are sold in different weights and weights, as a well-established sales method by commercial custom, and are offered for sale in different weights and methods, in order to protect the economic interests of consumers, to ensure accurate and complete information and to prevent consumer grievances, the weight information of the products must be included in the tariff and price lists as a distinguishing feature.

In this regard, it has been stated that in the tariff and price lists of businesses that provide food and beverage services, in addition to the matters stipulated in Article 54 of the Law on Consumer Protection No. 6502 titled "Price tag" and the Price Tag Regulation, the weight information of the cooked meat, which is the main ingredient for döner and iskender products, and the cooked hamburger patty, which is the main ingredient for hamburger products, must be included; otherwise, administrative sanctions will be imposed.
